A Misguided Path to Justice

In this first edition of our Leading Light quarterly feature, we chronicle a complex journey through Family Law Court complicated by unresolved trauma.

Shortly after their son was born in March of 2014, Mr. Caesar sought a divorce and full custody due to safety concerns and repeated infidelity. Despite securing initial custody, ongoing disputes arose as the mother's escalating mental illness, rooted in past trauma, fueled significant legal conflicts. The legal battles continued, marked by renewed disputes.

Following a failed attempt to rebuild their relationship, the pandemic’s unique circumstances allowed Mrs. Caesar to testify without ever being seen by the judge. A landmark ruling evoked a new definition of domestic violence for the first time, underscoring ongoing efforts to ensure accountability in family law. However, did the courts' efforts to protect the child end up causing more harm?

A gripping, emotionally charged story which illustrates the challenges of navigating family law when mental illness is involved, the dangers of a low standard of proof, and the crucial need for firmly maintained boundaries. This case also highlights the profound impact of contentious proceedings on the children—the only truly innocent parties involved.
